Op 4 april 2025 heeft de Hoge Raad geoordeeld dat er een regeling moet komen voor de toelating van civiele advocaten uit het Caribisch deel van het Koninkrijk tot de balie bij de Hoge Raad. Daarmee erkent de Hoge Raad dat deze advocaten in beginsel ook tot cassatieprocedures zouden moeten kunnen worden toegelaten, mits aan bepaalde voorwaarden wordt voldaan.

De aanleiding voor deze uitspraak was een zaak van een advocaat gevestigd op Bonaire, die tevergeefs had verzocht om als advocaat bij de Hoge Raad te worden ingeschreven. Zijn verzoek werd eerder door het gerecht in eerste aanleg en het Gemeenschappelijk Hof van Justitie afgewezen. Beide instanties erkenden weliswaar dat er sprake is van ongelijke behandeling, maar vonden die gerechtvaardigd vanwege de verschillen in organisatie en toezicht binnen de advocatuur en rechterlijke macht tussen Europees en Caribisch Nederland.

De Hoge Raad volgt deze redenering, maar benadrukt tegelijkertijd dat de huidige situatie geen eindstation mag zijn. De toelating van Caribische advocaten tot de cassatiepraktijk moet volgens de Hoge Raad nader worden geregeld door de Nederlandse Staat. Er zijn inmiddels stappen in die richting gezet, onder meer door overleg over kwaliteits- en toezichtsnormen.

Hoewel de Hoge Raad nog geen einde maakt aan de bestaande ongelijkheid, onderstreept deze uitspraak wel dat er serieuze aandacht is voor een structurele oplossing.

Belangrijk detail: cassatie door Caribische advocaten is al mogelijk in strafzaken, zoals geregeld in de Rijkswet cassatierechtspraak voor Aruba, Curaçao, Sint Maarten en voor Bonaire, Sint Eustatius en Saba. Ook de Hoge Raad zelf benoemt dit op zijn website: artikel 13 van de rijkswet bepaalt expliciet dat advocaten die zijn ingeschreven bij het Gemeenschappelijk Hof als raadsman kunnen optreden in strafzaken bij de Hoge Raad. Voor civiele zaken ontbreekt deze mogelijkheid dus nog.

Met deze uitspraak komt daar hopelijk op termijn verandering in.

On Friday, January 17th, 2025, the Bas Association of Sint Maarten hosted its annual New Year’s reception to toast to the start of a promising year. The event was graced by the presence of esteemed guests, including His Excellency the Governor, the Vice Chairman of Parliament, the Prime Minister, and the Minister of Justice.

We were also honored to welcome judges Drenthe, Van Vuure, and Martinez-Hammer, as well as Attorney General Boswijk, Notary Richards, and Bailiff Apon, whose presence made the evening truly complete.

Another successful visit by Dean Zylena Bary as she continues her mission to identify and address the concerns within the legal profession! This time, Dean Zylena Bary visited Hoeve & Rogers.

As part of her inventory of what concerns live amongst the legal profession, Dean Zylena Bary is visiting law firms to hear what is on attorneys’ mind. Last week she stopped by BZSE Attorneys at Law / Tax Lawyers and Lexwell Attorneys to have a productive conversation on various matters.

The board of the Sint Maarten Bar Association, represented by Dean Zylena Bary, was excited to gather clothes, toys and snacks and present them to the New Beginnings for Children Foundation's Ms Sally Benjamin for this holiday season. The Sint Maarten Bar Association wishes to usher in their own new beginning of being visible in the community in which they serve as attorneys.

The collected items bring an opportunity for the Bar Association to contribute hope and joy to the vulnerable children in our community during this festive season.

As lawyers, we champion  (among other things) justice and promote equality. There is arguably no group more deserving of having support during the holidays than displaced kids. Happy Holidays to all from the St Maarten Bar Association!

On December 5th, 2024, the Sint Maarten Bar Association held their elections to fill the available board positions. Attorney Zylena Bary was elected as the Dean of the Bar Association. The board positions are rounded out with Attorney Shaira Bommel as Vice Dean, Attorney Fehmi Kutluer as Treasurer and Attorney Daphne Schram as Secretary.

Attorney Bary is pleased to have a full board ready and eager to tackle the topics and/or issues being brought forward by the members of the Sint Maarten Bar Association. In the coming weeks, Dean Bary will be busy making an inventory of the top priorities among the members and addressing the relevant stakeholders (whether formally or informally). The official term of the board will commence on January 1st, 2025.
